2011: Delta PDP crisis deepens, as aspirants seek joinder application






The supremacy crisis in the Delta State chapter of the Peoples Democratic Party on Monday took a new dimension as more aspirants visited the Federal High Court in Abuja with their supporters, seeking to be joined in the suit.

They are two governorship aspirants; a House of Assembly aspirant and a House of Representatives aspirant.

Bernard Ofubu, Ebikeme Clark, Saliba Mukoro and Braduce A. Angozi who sought to be the third, fourth, fifth and sixth claimants respectively in the suit, further sought an order of the court setting aside its earlier interim order made on October 18.

The applicants told the court that their application also sought to bring the issues in contention before the court for effective determination.

According to them, the Independent National Electoral Commission and PDP who are the third and fourth defendants in the suit at a Federal High Court in Asaba, had filed a notice of preliminary objection challenging the jurisdiction of the court to entertain the suit.

Lawyer to the PDP Chairman, Patrick Ikwueto (SAN) while opposing the application, told the court that the same people asking to be third, fourth, fifth and sixth claimants were the people asking to be defendants.

He also urged the court to dismiss their application, adding that it was not proper for a party to be both claimant and defendant in a suit.

Justice Abdul Kafarati therefore adjourned the case till November 14 for his ruling on whether or not to join the new parties in the case.

The judge had restrained INEC from investigating or calling for the dissolution of the state executive committee of the PDP in Delta State.

Justice Kafarati had also restrained the PDP from acting on the letter written by INEC preventing the defendants from exercising their functions as members of the state executive committee, pending the determination of their Motion on notice.

The court further restrained INEC from excluding the plaintiffs from participating in the process of or taking actions and decisions in respect of the forthcoming 2011 General Elections pending the determination of the matter.

The plaintiffs, Peter Nwaoboshi and Solomon Ogba, who sued for themselves and on behalf of the Delta State executive committee of the PDP sought the reliefs.
